Highlights of today’s alert include Los Angeles County dealership reopening details, Governor Newsom’s executive order creating COVID-19 workers’ compensation benefit presumption, an extension on PPP loan safe harbor deadline, information about CNCDA’s upcoming free webinar and access to today’s NADA webinar recording.  

Daily Highlights 
Los Angeles County Announces Reopening of Dealership Showrooms on Friday; Details Forthcoming 
Earlier today, Los Angeles County officials announced that dealership showrooms will be allowed to reopen on Friday May 8, as long as appropriate health and safety precautions are taken. (Click here.) The Greater Los Angeles New Car Dealers Association (GLANCDA) has also received confirmation that the cities of LA, Long Beach, and Pasadena intend to issue orders mirroring the County order, which will allow dealership showrooms to reopen in jurisdictions throughout the County. 

Although this is a very positive development for LA County dealerships, dealers should note that the orders allowing showrooms to reopen have not yet been issued. It’s our understanding that the final orders will be issued by end of business tomorrow (May 7). Dealers are strongly encouraged to closely review these orders once they become available, as they may contain restrictions on in-person sales that we are unaware of at this time. 

Governor Issues Executive Order Creating COVID-19 Workers’ Compensation Benefit Presumption
Earlier today, Governor Newsom signed an executive order that creates a time-limited rebuttable presumption for accessing workers’ compensation benefits applicable to Californians who must work outside of their homes during the stay at home orders. (Click here.) This order makes it much easier for employees that contract COVID-19 to qualify for workers’ compensation benefits. 

The Governor’s order is retroactive to March 19 and continues for 60 days after today’s date.
Deadline to Return PPP Loans and Qualify for Employee Retention Credit Extended Until May 14
Some larger dealerships (particularly publics) have decided to return Paycheck Protection Program (PPP) loans due to changes in program guidance. (See, e.g., Department of the Treasury PPP FAQ #31, click here.) Earlier today, the Department of the Treasury (DOT) extended the safe harbor deadline to repay these loans from May 7 to May 14. (See FAQ Question #45, click here.) The DOT further clarified that businesses that return a PPP loan by May 14 may qualify for the Employee Retention Credit, which is ordinarily unavailable to businesses that receive PPP loans.
